Terms of service

Rules for using the ShipViaUS website and tools. Your carriage and service contracts may add or override terms where they apply.

Full terms

Last updated: 2026-01-01. These terms govern use of the ShipViaUS website, tools, and related digital services. They are not a substitute for executed carriage, warehousing, or service agreements, which control where they expressly apply.

1. Agreement

By accessing or using ShipViaUS properties at shipviaus.org and related subdomains (the “Site”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Site. We may update these Terms; the “Last updated” line will change and your continued use after posting constitutes acceptance of the revised Terms.

2. Eligibility and accounts

You represent that you have authority to bind yourself or the organization you represent. Where the Site offers forms, tracking lookups, or quote requests, you agree to provide accurate information and to keep credentials confidential. You are responsible for activity under your session.

3. Not an offer; reliance

Materials on the Site are for general information. Rates, transit times, capacity, and compliance requirements vary by lane and jurisdiction. Nothing on the Site is an offer capable of acceptance until confirmed in writing under ShipViaUS’s standard contracting process. Do not rely on the Site as the sole source for operational or legal decisions affecting shipments.

4. Acceptable use

You will not: (a) probe, scan, or test vulnerabilities without authorization; (b) overload, disrupt, or attempt unauthorized access to systems or data; (c) use the Site to transmit malware or unlawful content; (d) misrepresent identity or affiliation; (e) scrape or harvest data in bulk except as allowed by robots.txt or express permission. We may suspend access for violations.

5. Intellectual property

ShipViaUS and its licensors own the Site, branding, text, graphics, and software, protected by applicable laws. You receive a limited, revocable license to use the Site for its intended purpose. No license is granted to our trademarks except as needed to describe ShipViaUS in good faith.

6. Third parties and links

The Site may reference or link to third-party tools, maps, or carriers. Those parties’ terms and privacy practices apply to their services. ShipViaUS is not responsible for third-party content or downtime.

7. Tracking and demo features

Tracking, quotes, and contact submissions may be provided for demonstration or operational purposes depending on deployment. Information displayed may be illustrative or subject to latency. Executed bills of lading, airway bills, warehouse receipts, and signed service orders prevail over any conflicting summary on the Site.

8. Disclaimers

THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ShipViaUS AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SITE IN ANY TWELVE-MONTH PERIOD WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (USD $100) OR (B) THE AMOUNTS YOU PAID ShipViaUS SPECIFICALLY FOR SITE-RELATED SERVICES IN THAT PERIOD, IF ANY.

10. Indemnity

You will defend, indemnify, and hold harmless ShipViaUS and its personnel from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site, violation of these Terms, or violation of third-party rights.

11. Governing law and disputes

These Terms are governed by the laws of the State of Texas, USA, excluding conflict-of-law rules. Subject to applicable law, exclusive venue for disputes arising from these Terms or the Site lies in the state or federal courts located in Harris County, Texas. You consent to personal jurisdiction there.

12. Severability and assignment

If any provision is held unenforceable, the remainder stays in effect. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
